Not So Fast!: Federal Judge Puts Pause on New Mexico Governor's Second Amendment Ban
A federal judge on Wednesday put the kibosh on a controversial order from New Mexico Gov. Michelle Lujan Grisham, who decided to declare a “public health emergency” and suspend the constitutional right to bear arms in Albuquerque—the order that earned her justifiable pushback, including from me. Not so fast, the judge, who was, ironically, appointed by President Joe Biden, ruled.
U.S. District Court Judge David Urias cited the Second Amendment when temporarily halting Lujan Ghisham’s order. As Reuters noted:
U.S. District Court Judge David Urias said the governor's 30-day suspension of concealed and open firearm carry rights in Albuquerque and its surrounding county went against a landmark U.S. Supreme Court ruling that people had a right to carry a gun outside their homes for self defense.
"The violation of a constitutional right, even for minimal periods of time, unquestionably constitutes irreparable injury,” he stated during the hearing, Fox News reported.
The futility of Lujan Grisham’s overstep is obvious, even to her. She admitted to reporters it would not stop criminals. If this order is put in place as an emergency measure, it should have some bearing on whatever one is labeling an emergency. To know it won’t but to do it anyway seems to be the epitome of ridiculousness and an abuse of power. Not only that, but as I pointed out in my piece here, it puts law-abiding citizens in jeopardy. Criminals don’t obey gun bans, and they also know good people often do, so would that not, then, be a perfect time to take advantage of the sitting ducks? Come on, people. Think!

Thankfully, some people are thinking, for even before Urias’s decision, individuals said they would not comply, and the police chief determined he would not enforce it.
